PRIVACY POLICY

• We process personal data provided to us by our Customers in a manner consistent with the scope of consent granted by them and legal requirements, in particular in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws No. 133, item 883, as amended) and Implementing Decision (EU) 2016/1250 adopted pursuant to Directive 95/46/EC of the European Parliament and of the Council. We store your personal data on servers that ensure their full security (SSL certificate).
• Only authorized Store employees have access to the database.

Customer data is collected primarily for the purpose of creating a personalized account in the Onyx Tan store. It is also used to conclude and execute the purchase agreement (obtaining a shipping address for purchased goods) and for any complaints procedure.

After expressing separate consent, data may also be processed for the purpose of sending text information electronically for direct marketing purposes, including the promotion of our content.

The Store does not transfer, sell or lend collected personal data of Customers to third parties, unless it is done with the express consent or at the request of the Customer or at the request of legally authorized state authorities in connection with ongoing proceedings.

If it is necessary to provide our services, personal data may be made available to mailing operators for the purpose of sending the newsletter (Mailchimp.com or Freshmail.com), as well as to a company intermediating in electronic payments (PayPal Polska Sp. z o. o.) and Przelewy24.

On our websites we use technologies such as cookies and similar to collect and process operational data in order to personalize the content provided and to analyze traffic on our websites through our partners (Google, Facebook).

The store does not use customer profiling (a form of automated data processing involving assignment to a specific group of customers).

Personal data processed for marketing purposes covered by the declaration of consent will be processed until the consent is withdrawn.

The data controller, within the meaning of the Act of 29 August 1997 (Journal of Laws 1997, No. 133, item 883, as amended), is Onyx International Sp. z o. o.

If the website does not require the customer to accept (check a checkbox) a clause consenting to the processing of personal data when, for example, creating an account or placing an order, the privacy policy should include a provision such as: "Using the website requires the processing of the customer's personal data in the following scope: .... (e.g. name and surname, telephone number, email address, etc.). The data will be processed by ... (merchant name) to the extent necessary to conclude and perform the contract. Transaction data, including personal data, may be transferred to Przelewy24 with its registered office in Poznań, ul. Pastelowa 8, 60-198, Poznań, NIP: 779-236-98-87, REGON: 301345068 to the extent necessary to process payment for the order. The customer has the right to access and correct their data. Providing data is voluntary and at the same time necessary to use the website."

We store customer personal data on secure Shopify Secure servers. Only selected employees have access to the data. The location and method of data storage are designed to ensure complete security.

Every customer who has provided us with personal data has full access to their data for the purposes of review, verification, modification, rectification, restriction of processing, transfer, and deletion. They also have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Customers can also independently add to and edit their data by logging into their individual account.

If it is found that the processing of personal data violates the provisions of the GDPR, the data subject has the right to lodge a complaint with the President of the Personal Data Protection Office.

We only send advertising and promotional materials to our customers if they have given their consent. This applies in particular to newsletters sent to customers who have explicitly confirmed their consent to receive newsletters about current promotions, discounts, and new products in our store. These materials relate solely to our store's offerings.

We send promotional, special occasion and discount coupons to customers who have joined the loyalty program or have previously agreed to this by placing an order in our online store.

Providing personal data is voluntary, however, providing marked personal data is a condition for the implementation of the Onyx International service.

Privacy Enhancement (GDPR)

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, after May 25, 2018, each person must consent to the processing of personal data and its use for internal statistical and marketing purposes, as well as for correspondence related to the order, by Onyx International Sp. z o.o. Providing personal data is voluntary, but necessary for the proper implementation of the Service. At the same time, the customer has the right to access, correct, or delete their data. The personal data controller is Onyx International Sp. z o.o.
