1. GENERAL PROVISIONS

These Terms and Conditions apply exclusively to the European version of the Onyx online store. The store is operated by ONYX INTERNATIONAL sp. z o.o., a company established in Poland.

These Terms and Conditions define the rules for using this website and purchasing products sold through this store. They apply to both consumers and business customers, to the extent described below.

We process customer data in line with applicable EU data protection law, including the General Data Protection Regulation (GDPR). Details are provided in our Privacy Policy.

2. ONLINE SERVICES

In this store you can in particular:

  • create a customer account – free of charge and active until deleted,
  • place orders using the online checkout process,
  • subscribe to our newsletter – you may unsubscribe at any time.

To use the store, you need Internet access, a valid email address and a standard web browser (such as Chrome, Firefox, Safari or Edge). Cookies and JavaScript should be enabled.

You must use the store lawfully and refrain from uploading unlawful or harmful content.

3. SALES

A sales contract is created once we confirm your order by email. By placing an order, you make an offer to purchase the products in your cart in accordance with these Terms and Conditions.

Unless otherwise stated, prices are shown in EUR and include applicable VAT.

Promotions, discounts or special offers may be subject to additional terms displayed on the product page or during checkout.

Order confirmations are sent by email. You are responsible for providing a correct email address and ensuring your mailbox is accessible.

In the case of obvious errors (such as clear pricing or technical errors), we may cancel the order. If cancellation occurs after payment, we will refund all amounts paid without undue delay.

4. PAYMENT

You can pay using the secure payment methods made available at checkout, which may include:

  • Visa, MasterCard or American Express,
  • PayPal,
  • Klarna (where available),
  • Przelewy24 and selected local banking methods,
  • Shop Pay,
  • Google Pay (G Pay).

Payment options depend on your country and the availability of our payment partners.

Payment is due immediately after placing the order. Orders not paid within 7 working days may be cancelled automatically.

5. DELIVERY

We deliver to the countries shown as available during checkout. Availability is checked automatically once you enter your delivery address.

Orders are processed in our EU warehouse in Poland. Order processing normally takes up to 1 working day. Delivery times depend on the destination and selected shipping method.

Shipping costs are calculated automatically at checkout based on delivery country, address and order weight. All available options and final prices are displayed before payment.

Delivery times provided at checkout are estimates supplied by the carrier.

6. COMPLAINTS

Products must match the description and be free from defects. If your order is damaged, incomplete or incorrect, you may submit a complaint.

Please include:

  • your order number,
  • a description of the issue,
  • your preferred solution (e.g. replacement or refund),
  • photos, if they help illustrate the issue.

We respond as quickly as possible and no later than 14 days. If we do not reply within this time, your complaint may be treated as accepted under applicable law.

Your statutory rights regarding lack of conformity remain unaffected.

7. DISPUTES & ALTERNATIVE RESOLUTION

We aim to resolve issues directly with you. If a dispute remains unresolved, you may seek assistance from consumer protection authorities in your EU country.

For information on consumer rights and dispute resolution within the European Union, you can visit the official EU Consumer Dispute Resolution platform .

We are not obliged to participate in any specific alternative dispute resolution scheme, but we may consider such options individually.

8. RETURNS & RIGHT OF WITHDRAWAL

As an EU consumer, you have a 14-day right of withdrawal for online purchases, starting from the day the goods are delivered. You do not need to provide a reason.

To exercise the right of withdrawal, contact us via email or the Contact page with a clear statement.

Exceptions

The right of withdrawal does not apply to:

  • sealed goods unsuitable for return for health or hygiene reasons once unsealed (e.g. opened cosmetic products),
  • personalised or custom-made items,
  • certain digital content once access has been provided, if you consented.

9. BUSINESS CUSTOMERS

This section applies to purchases made for business purposes. We may cancel business orders within 14 days in cases of obvious pricing errors, technical issues or logistical reasons.

To the extent permitted by law, we are not liable for indirect losses, loss of profit or loss of business, except in cases of intentional misconduct, gross negligence or mandatory liability rules.

For business customers, the risk of accidental loss or damage passes to the customer once the parcel is handed to the carrier.

10. PERSONAL DATA

We process personal data in accordance with GDPR and applicable national laws. Data is used to process orders, provide support and – if you agree – send newsletters and marketing information.

You have the right to:

  • access your data,
  • correct or update your data,
  • request deletion or restriction,
  • object to processing (including direct marketing),
  • request data portability, where applicable.

You may lodge a complaint with a data protection authority in your EU member state.

11. FINAL PROVISIONS

These Terms and Conditions and contracts concluded through this website are governed by Polish law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in the EU, this choice of law does not deprive you of mandatory rights granted by the consumer protection laws of your country of residence.

We may update these Terms and Conditions from time to time. Updates apply only to future orders and will be published on this page.
